By creating an account, accessing, or using Bitey, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use the App. If you are using Bitey on behalf of a minor, you accept these Terms on their behalf and are responsible for their use of the App.

2.Description of Service

Bitey is a mobile application that provides the following features:

• Product search: Search for snacks and food products by name or category
• Barcode scanning: Scan product barcodes to retrieve product information
• Safety classifications: Personalized allergen safety ratings (Safe, Caution, Unsafe) based on your allergen profile
• Saved lists: Save and organize products for future reference
• Product comparison: Compare products side by side with full nutrition facts
• Community: Share tips, safe finds, and product reviews with other users

When you create an account with Bitey, you agree to:

• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Provide accurate and complete information during registration and keep it updated

5.Limitation of Liability

To the fullest extent permitted by applicable law:

• Bitey is not liable for any allergic reactions or health consequences resulting from the use of our safety classifications or product information
• We make no guarantee of the accuracy, completeness, or timeliness of product data, ingredient lists, or safety classifications
• Product data is sourced from third-party databases (including Open Food Facts and manufacturer data) and may contain errors or outdated information
• Cross-contamination risks are not always captured in ingredient data and may not be reflected in safety classifications
• Our maximum aggregate liability shall not exceed the total amount you have paid to Bitey (if any) in the twelve months preceding the claim

6.User Conduct

When using Bitey, you agree not to:

• Post false or misleading information about products or allergens
• Engage in harassment, bullying, or abusive behavior toward other users
• Send spam or unsolicited promotional content
• Impersonate other users, organizations, or Bitey staff
• Attempt to gain unauthorized access to other user accounts or our systems
• Use the App for any unlawful purpose or in violation of any applicable laws

7.Intellectual Property

All content, features, and functionality of Bitey — including but not limited to the app design, logos, mascot ("Bitey"), text, graphics, and software — are owned by Bitey and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.

8.Product Data Sources

Bitey uses product data from multiple sources, including Open Food Facts (an open-source product database) and manufacturer-provided data. While we strive to provide accurate information, product formulations may change without notice. You should always verify product safety by reading the actual product label before consumption.

9.Indemnification

You agree to indemnify, defend, and hold harmless Bitey, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another party.

10.Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of Bitey at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

11.Changes to Terms

We may update these Terms of Service from time to time. When we make significant changes, we will notify you through an in-app notification. Your continued use of Bitey after changes are posted constitutes your acceptance of the updated Terms.

12.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bitey operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.
